A federal judge on Monday ruled that a generic drug coupon offered by CVS and Walgreens will be accepted by customers on a sliding-scale basis.
“The generic drug coupon is the most important benefit of this deal and provides customers with an affordable alternative to the branded drug,” said David H. Gerber, a partner at the law firm SmithKline Beecham LLP. “This is not a ‘miracle deal,’ it is a savings deal.”
CVS and Walgreens recently offered to pay $10 off of the cost of a 20 mg Viagra coupon. However, CVS and Walgreens has also paid an additional $3 off of the $6 coupon.
“The savings offered by the generic drug coupon is not for consumers who are taking an effective drug,” said Judge Steven E. Kavaler, who is in court on a $1.4 million verdict against CVS and Walgreens.
Wal-Mart Stores Inc. and its subsidiary Walmart will pay $1.2 million to consumers who have taken an effective drug coupon. CVS and Wal-Mart will pay the same $10.8 million.
The CVS and Wal-Mart settlement will apply to all drug coupons from April 1, 2007, to April 1, 2011, and to the April 1, 2011, coupon as of April 1, 2008.
